By accessing or using the services provided by Fortify Risk AI ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions, you may not access or use our services.

2. Description of Services

Fortify Risk AI provides AI risk management and security services for organizations developing or implementing AI systems, including but not limited to:

  • Rapid-Risk Audits
  • Pilot Build & Guardrails
  • Monitoring Retainer
  • Team Enablement

3. User Accounts

To access certain services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account
  • Update your information to keep it current
  • Protect your account credentials and not share them with third parties
  • Notify us immediately of any unauthorized use of your account

4. Service Fees and Payment

Fees for our services are as stated on our pricing page or in a separate written agreement. Payment terms are as follows:

  • Payment is due according to the terms specified in your agreement
  • We accept major credit cards, wire transfers, and ACH payments
  • Prices are subject to change with notice
  • Refunds are provided in accordance with our money-back guarantee policy

5. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of Fortify Risk AI or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for your internal business purposes.

6. User Content

You may have the opportunity to submit content to our services, including feedback, testimonials, or other materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You represent and warrant that:

  • You own or control all rights to the User Content you submit
  • The User Content does not infringe upon the rights of any third party
  • The User Content is not illegal, obscene, defamatory, threatening, invasive of privacy, or otherwise objectionable

7. Confidentiality

We recognize that we may have access to sensitive information about your business and AI systems. We agree to maintain the confidentiality of your information and not disclose it to third parties except as necessary to provide our services or as required by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FORTIFY RISK AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

OUR LIABILITY IS LIMITED TO THE AMOUNT YOU HAVE PAID US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

10. Term and Termination

These Terms shall remain in effect until terminated by either you or us. We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the services will immediately cease.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.
